Appellate Success to Preserve Defense Verdict at Trial

Ecoff Campain & Tilles, LLP was retained to represent client on appeal from a defense verdict at trial. Plaintiff filed a civil lawsuit against client to regain possession of the property and recover monetary damages and attorney’s fees for breach of lease. At trial, the jury rejected plaintiff’s damage claims, found in favor of the client and awarded client its attorney’s fees.

Plaintiff appealed on several grounds including that it was entitled to unpaid rent as a matter of law and that the trial court erred in denying its JNOV, excluding evidence, and refusing special jury instructions, among other things. Attorney Yaron Tilles successfully represented client on appeal. Following oral arguments, the Court of Appeal issued its decision affirming the client’s defense verdict and affirming the client’s attorney’s fees award in excess of $180,000.
